EIS or CEA?
The MN Court of Appeals has ruled in Friends of the Headwaters and the MCEA's case. They have decreed that, UNDER MN LAW, an EIS is necessary, BEFORE Enbridge can proceed with pipeline approval process.
In its response to the Court of Appeals ruling in favor of Friends of the Headwaters, Enbridge public relations continues to spew the lie that the Comparative Environmental Analysis (a CEA) is the equivalent of an Environmental Impact Statement (an EIS).

Rail Transport of Oil vs Grain
Total oil production from North Dakota has risen from 150,000 barrels per day (BPD) in 2008 to over 1,000,000 BPD in 2014. Crude oil shipment by rail has drastically increased while grain and other commodities are waiting for transport, placing additional pressure on states to approve risky pipelines. We are NOT against oil or pipelines. The MN PUC is not disregarding this railroad issue but is attempting to ensure that the environmentally safest route is chosen for any new pipelines that need to cross the state.
Railroads represent a flexible alternative to pipelines as they offer a geographically extensive grid-work that are better able to serve as routes from new areas of production to refineries. The US has 140,000 miles of railroad and 57,000 miles of crude oil pipelines. Railroads were deregulated in 1980. The federal Surface Transportation Board (STB) is now responsible for the oversight of railroads. At the urging of elected officials in both MN and ND, the STB will now require more complete data on rail shipping delays. Click for more information Farmers deserve to get their grain to market. Balancing the transport needs of agriculture, energy, industry and passenger is difficult but necessary.
In the meantime, to ease the bottleneck, and since there is currently a glut of oil in the US due to decreased demand as well as near record US oil production, could we consider leaving a little more oil in the ground so that our food can make it to markets? The oil will not rot but our food will. Farmers deserve a fair shake.
